SureSend Courier Service
1. Acceptance of Terms
These Terms & Conditions constitute a legally binding agreement between the customer and SureSend Courier Service. By accessing or using any service provided by SureSend Courier Service, the customer acknowledges that they have read, understood, and agreed to be bound by these Terms & Conditions, as amended from time to time.
2. Nature of Services
SureSend Courier Service provides courier, freight forwarding, and logistics facilitation services only. SureSend Courier Service does not act as:
* A seller or retailer of goods
* A manufacturer or distributor
* An insurer or guarantor of merchandise
All goods are shipped at the sole risk of the customer, subject to the limitations set out herein.
3. Shipping Schedule and Service Estimates
SureSend Courier Service processes shipments three (3) times per week, subject to operational capacity, carrier availability, customs processing, weather conditions, public holidays, and other factors beyond its reasonable control.
All shipping schedules and delivery timelines are estimates only and shall not be construed as guaranteed delivery dates.
4. Customer Obligations
The customer bears sole responsibility for:
* Ensuring all items are lawful and permitted for import into Jamaica
* Accurate and truthful declaration of shipment contents and value
* Compliance with all customs, regulatory, and statutory requirements
* Proper packaging by the sender or originating retailer
* Payment of all shipping charges, customs duties, taxes, storage fees, and related costs
* Providing accurate contact and delivery information
SureSend Courier Service shall not be liable for any loss, delay, penalty, seizure, or expense arising from customer error, omission, misrepresentation, or non-compliance.
5. Prohibited and Restricted Goods
SureSend Courier Service does not accept, transport, or handle prohibited or restricted goods, including but not limited to:
* Illegal or controlled substances
* Firearms, ammunition, weapons, or components thereof
* Explosive, flammable, or hazardous materials
* Live animals or perishable items
SureSend Courier Service reserves the unrestricted right to refuse, detain, surrender to authorities, return, or dispose of such shipments without notice or liability. All resulting consequences, including fines, forfeitures, or losses, remain the sole responsibility of the customer.
6. Customs and Governmental Authority
SureSend Courier Service exercises no control over customs authorities or governmental agencies. Accordingly, SureSend Courier Service shall not be responsible or liable for:
* Customs inspections or holds
* Seizures or confiscations
* Additional duties, taxes, penalties, or fees
* Regulatory enforcement actions
Delays or actions taken by customs or other authorities shall not constitute grounds for service cancellation, refund, or legal claim against SureSend Courier Service.
7. Delivery Delays and Force Majeure
SureSend Courier Service shall not be liable for delays or non-performance resulting from causes beyond its reasonable control, including but not limited to:
* Third-party carrier delays
* Airline or shipping line disruptions
* Weather conditions
* Acts of God
* Labour disputes
* System failures
* Governmental actions
8. Notification, Storage, and Collection
Customers will be notified upon arrival of shipments in Jamaica. Failure to collect packages within a reasonable period may result in storage fees or other administrative charges.
SureSend Courier Service is not responsible for losses or delays arising from customer unavailability or failure to respond to notifications.
9. Loss, Damage, and Claims (Strict 15-Days Limitation)
SureSend Courier Service shall not be responsible for loss or damage caused by:
* Inadequate or defective packaging
* Manufacturer defects
* Pre-existing damage
* Customs inspections or handling
* Third-party carriers or vendors
Any claim for loss or damage must be submitted in writing within fifteen (15) days of shipment arrival notification. Claims submitted after this period are absolutely barred and will not be considered under any circumstances.
10. Limitation of Liability
To the maximum extent permitted by law, SureSend Courier Service shall not be liable for any indirect, incidental, consequential, or economic loss, including loss of profits, business interruption, or loss of use.
Any liability, where legally established, shall be strictly limited to the amount paid for the shipping service only and shall not extend to the value of the goods shipped.
11. Right to Refuse Service
SureSend Courier Service reserves the right, at its sole discretion, to refuse service to any customer or shipment without obligation to provide justification.
12. Amendments
SureSend Courier Service reserves the right to amend these Terms & Conditions at any time without prior notice. Continued use of services constitutes acceptance of any revised terms.
13. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of Jamaica, and the courts of Jamaica shall have exclusive jurisdiction.
14.REFUNDS & CLAIMS POLICY
SureSend Courier Service
* Shipping fees are non-refundable once services have commenced
* No refunds are issued for delays caused by customs, carriers, weather, or force majeure
* Claims must be filed within 15 days of arrival notification
* SureSend Courier Service does not insure shipment value
* Claims submitted after 15 days are permanently waived
* SureSend Courier Service is a logistics provider only
* Delivery timelines are estimates, not guarantees
* Customers assume full responsibility for customs compliance
* No liability for customs actions or third-party delays
* All claims must be filed within 15 days.
